Hathras case : UP govt seeks CBI probe monitored by SC

CM Yogi Adityanath led Uttar Pradesh government seeks Supreme Court of India monitored timebound CBI probe into the alleged gangrape-cum-death incident at Hathras and averted adverse remarks from the court caustic by reiterating that it wanted ‘free and fair’ investigation into the “much politicised” incident.

As a general rule the states do not mark presence without SC issuing notice and also resist CBI probe into any incident that has taken place in their jurisdictions. The UP government’s surprising request came unilaterally, without even the SC calling for it or issuing it notice on a PIL which was taken up for hearing by a bench of Chief Justice S A Bobde, A S Bopanna and V Ramasubramanian hours after the state filed an affidavit saying it was committed for a “free and fair” investigations uninfluenced by extraneous considerations.
The state said though the state police has diligently investigated the crime as and when the charges were made and modified by the victim while being treated in a hospital, it had requested the Centre for a CBI probe finding vested interests and political parties trying to take undue advantage and tarnish the image of the state and the chief minister by peddling false and motivated narratives through social and other media.
