RERA Orders City Builder To Repair Leaky Walls

In a case that highlights buyer’s rights when it comes to newly constructed properties, a homebuyer who found defective civil work in his apartment approached RERA which prevailed upon the builder to make proper repairs.

According to the case details, a man bought a flat on the tenth floor of a newly built apartment near Malav Talav in Vasna area and got possession on May 19, 2022.

He observed damp spots on the walls and brought it to the attention of the builder before taking possession. The builder carried out repairs and assured him that the problem won’t recur. However, once the buyer shifted to new premises, the problem persisted with moisture oozing from the walls and the paint peeling off. The problem was so grave that his furniture and electrical connections got damaged. Even the plaster eroded and fell off in certain sections of the wall.

The buyer filed a complaint with RERA and sought an alternative apartment until his complaint was resolved. During the hearing, the builder denied all the allegations and attributed the problem to improper interior work done by the vendors hired by the buyer. He argued that the buyer had taken possession of the apartment after doing all the checks.

The matter got aggravated to such an extent that the buyer and builder filed police applications against each other, claiming they were being intimidated by the counterparty.

After hearing all the parties, the RERA authority noted in the order that the builder was ready to settle the issue by undertaking the repair, plaster, putty and paint work. After the repairs were undertaken and completed, the RERA authority dismissed the plea.
